KAMBA TRAVEL & TOURS STANDARD TERMS & CONDITIONS
- Kamba Travel & Tours is Financially Bonded with Towergate Travel through Zurich Insurance PLC in accordance with UK Package Travel Regulations.
- By making a booking with Kamba Travel & Tours, the guest acknowledges that he or she has read and understood these terms and conditions and hereby agrees to be bound by these.
- Kamba Travel & Tours may work as the tour operator or may sub-contract other tour operators in the country of travel. Tours arranged by Kamba Travel & Tours themselves and in their own name, and Tours arranged by other Tour Operators and for which Kamba Travel & Tours only acts as agent. For each tour booking the responsible Tour Operator is named. The terms and conditions which follow apply only to tours offered and arranged by Kamba Travel & Tours themselves. For tours arranged by other Tour Operators but for which Kamba Travel & Tours only acts as agent, the terms and conditions of the operator of the tour apply, and for such tours Kamba Travel & Tours does not accept responsibility as Tour Operator.
- The guest understands and agrees that he or she enters into a binding contract with Kamba Travel & Tours at the time that Kamba Tours accepts and reserves a booking by the guest. The contract is also binding on all fellow guests on whose behalf the traveller has made the booking and he/she must accept the responsibility for their contractual obligations, as if it were his/her own. Kamba Travel & Tours will provide the traveller with a confirmation of the tour in writing or in text form either at the time of accepting the booking or immediately when the contract is settled.
- Should the contents of the confirmation of the tour deviate from the contents of the booking, it implies a new proposal from Kamba Travel & Tours in such a case, the tour contract, based on the new proposal, becomes effective only when the traveller explicitly expresses his/her acceptance of the new proposal through, for example, payment of the travelling costs.
- DEPOSITS & PAYMENTS: All packages must be prepaid. Within 7 days of a confirmation of all multi-day itineraries, a non-refundable deposit of 40% is required to secure the reservation. Until this is paid, Kamba Tours will not confirm the arrangements. Full payment must be received 12 weeks prior to departure.
- All charges are quoted in United States Dollars and are inclusive of VAT and Government Tourism Levy.
- NB: Specific suppliers of ours may have more stringent deposit policies which we will advise you of in advance as those will take precedence over these present terms and conditions.
- Kamba Tours reserves the right to withhold its services if you fail to adhere to any deadline.
- Quotations are subject to daily currency fluctuations. Package costs are only guaranteed once full payment has been received except where subsequent increases are beyond the control of Kamba Tours.
- Accepted payment methods include bank transfer, cash, credit card (in person or using our online payment gateway). For payment by bank transfer, all bank charges are for your account. Visa and Mastercard are accepted only when the card is presented in our office or when using our online payment gateway. Credit card payments incur a 5% service fee.
- COMPULSORY CHARGES: For its services Kamba Tours charges a handling fee which varies depending on scope of services to be offered and size of the group.
- VOUCHERS AND TICKETS: Documentation will only be prepared and issued on receipt of full payment.
- SPECIAL REQUESTS: If you have any special requests/ requirements, these must be specified in writing at time of booking. We will endeavour to assist you with these special requests but we cannot guarantee such. Kamba Tours will not be held liable for failing to comply with any special requests. You are required to provide us with dietary requirements for the group well in advance, in any event, no later than 7 days prior to the date of departure.
- PACKAGE EXCLUSIONS: Package quotes exclude all items of a personal nature (e.g., laundry, bar) unless otherwise stated. Extras may be charged to a Master Account in which case a group representative must sign the bill/s agreeing to the charges. Kamba Tours will invoice on the first working day after the group departs and will require immediate payment to settle with the establishment/s. Kamba Tours will levy a minimum fee of 8% on each Extras bill.
- AMENDMENTS: Should you require your confirmed services package to be amended, Kamba Tours reserves the right to charge an amendment fee in addition to any applicable cancellation charges. In the case of valid, important, and unforeseeable reasons that may necessitate changes before the contract is finalised, Kamba Travel & Tours reserves the right to announce a change in the package as well as the prospectus, about which the guest shall be informed before finalising the booking. Should the tour only start four months or longer after the tour contract has been finalised, Kamba Travel & Tours reserves the right – in the case of an increase in transport costs or fees for specific obligations, like harbour or airport duties, or changes in the exchange rates applicable to the specific tour – to change the costs accordingly. The guest shall be informed.
CANCELLATIONS:
- Packages: In the event of cancellation of a package for any reason the following general cancellation charges will be levied in most cases: 0-45 days prior: 100% cancellation charge; 46-90 days prior: 50% cancellation charge. Specific suppliers of ours may have more stringent cancellation policies which will take precedence over the present terms and conditions. A cancelation will only be accepted in writing.
- Day Trips & vehicle hire: All vehicle hires and day trips attract a 100% cancellation fee applicable if the cancellation is done less than 7 working days prior to service taking place.
- REFUNDS: Should there be no cancellation or amendment, as the case may be, but you fail to use all or some of the services or you do not show up, Kamba Tours shall not refund you. Any refunds shall be subject to the following terms:
- Refunds to credit cards: the relevant cancellation fee, less a 6 percent credit card surcharge and an administrative charge.
- Direct bank deposits: the relevant cancellation fee, less actual bank charges debited by Kamba Travel & Tours bankers, less an administrative charge.
- Forex transfers: the relevant cancellation fee, less actual bank charges debited by Kamba Travel & Tours bankers, less an administrative charge.
- Cash payments: the relevant administration charges, less actual bank charges debited by Kamba Travel & Tours bankers, less an administrative charge.
- DELAYS: Kamba Tours cannot be held responsible or liable for any delays prior to departure or during a tour, whether brought about by technical difficulties, strikes, adverse weather conditions or any other foreseen/unforeseen circumstances. Expenses incurred relating to delays are for the guest´s account.
- TRAVEL DOCUMENTS: The onus is on each guest to check that all travel documents are in order. Your Passport must have minimum of 6 months after intended return date and a minimum of 2 blank pages; guest should always carry their passport or a certified copy of the main page plus the visa page.
- Visas: The onus is on each guest to check the latest information pertaining to his/her nationality. Kamba Tours does not accept any responsibility for any consequences whatsoever resulting from a guest’s failure to ensure that he/she has complied with the necessary requirements. Specific countries may have specific visa requirements and it is the responsibility of the guest to familiarise themselves with these requirements.
- Health: It is the guest’s obligation to ensure that he/she is medically fit & able to embark upon travel. All those travelling from or in transit from a yellow fever destination should have a yellow fever certificate. One is encouraged to check the World Health Organization’s website for the latest health alerts.
- INSURANCE: It is highly recommended that guests traveling with Kamba Tours take out comprehensive travel insurance which covers cancellation & curtailment of trip, Covid-19 or Pandemic related claims, illness, baggage loss & default. By reading these Terms & Conditions, it is assumed that the passenger has purchased comprehensive travel insurance cover.
- INDEMNITIES: Any adventure activities or sojourns into the wild included in the itinerary must be considered dangerous. Kamba Tours and its suppliers do not hold themselves responsible for death, injury or loss, which may occur. All guests may be obliged to individually sign an Indemnity Form in this regard.
- CAR SEATS FOR CHILDREN: Kamba Tours does not provide car seats for children nor do our drivers fit the car seats due to safety reasons. We request all parents/guardians to supply and fit car seats for their children. Kamba Tours will not transport children below 5 years without car seats. Please contact us for further assistance in this regard.
- LIABILITY & RESPONSIBILITY: Kamba Tours, in arranging transportation, hotel accommodation, day tours or any other service, acts as agent only and is not liable as a principal. Kamba Tours shall not be held liable for injury, death, loss, damage, accident, delay or inconvenience, howsoever caused, during any journey, tour, accommodation or other service arranged or booked by Kamba Tours. Kamba Tours shall not be held liable for any expenses arising from any of the above. Whilst every effort has been made to ensure the highest standards of maintenance of all of ours and sub-contractor’s vehicles, boats & aircraft, a breakdown or delay could occur at any time, which is beyond our control. Any such breakdown or delay will be rectified as soon as is humanly possible to do so under prevailing conditions. Liability to passengers carried in any vehicle owned by Kamba Tours is governed by the laws of the country in which such service takes place, and all claims are subject to the jurisdiction of the courts of the country in which the cause of action take place. By reading these Terms and Conditions, you are hereby acknowledging that neither Kamba Tours, its members, servants, or agents shall be in any way liable for injury, loss nor damage to person or property sustained howsoever arising, by the guest / party or any other person accompanying the trip. Kamba Tours is hereby indemnified against all and any claims which may be made against it or any of its members or staff.
- FORCE MAJEURE: Either Party may suspend or terminate its performance obligations, partially or entirely, to the extent that its obligations are prevented by events or occurrences beyond its control including, without limitation, strikes; labour disputes; accidents, pandemics, epidemics, Government regulations, quarantines, curfews and travel advisories, natural disaster, fire, curtailment of hotel or transport operations, civil disorder, terrorism, acts of war or acts of God, Kamba Tours or the guest being unable to perform its obligations beyond the control of either Party making it illegal, impossible or commercially impracticable to provide the services in whole or in part, then either party may terminate the agreement. The deposits paid to date shall be held in credit for travel on the same programme at a later date for a period of up to 12 months from the Force Majeure. In such cases, Kamba Tours and all its suppliers will not be held liable for any damages caused as a result of the termination. Our suppliers may charge a higher rate based on their pricing structure based on the new travel dates / season booked up to 12 months. Termination for Force Majeure must be received by Kamba Tours from the guest within 7 days from the Force Majeure event or if the service is scheduled within 14 days then the termination must be received in writing within 24 hours of the Force Majeure event.
- POSSIBLE CHANGES: Kamba Tours and its service providers reserve the right to cancel any reservations prior to departure; in which event any payments made will be refunded without any further obligation. The duration of the package may have to be extended or curtailed owing to unforeseen changes in transportation schedules. Any resultant expense shall be borne by the guest and any saving refunded. For all packages, the right is reserved to substitute hotels of a similar or higher category at no additional cost to the guest. In case of bona fide unforeseen circumstances, e.g., a fire in booked accommodation or the cancellation of a flight, over which Kamba Travel & Tours has no control whatsoever and which occur after the finalisation of a contract, Kamba Travel & Tours reserves the right to make changes in the bookings or flights to best suit the traveller and to least upset his/her itinerary. Kamba travel & Tourism, however shall inform the traveller about such changes as soon as is reasonably possible.
- LEGAL JURISDICTION: This agreement shall be construed under the laws of Zimbabwe and if any legal action is brought under this agreement, such legal action shall be brought in courts of Zimbabwe without reference to any choice of law doctrine, except in circumstances referred to in clause u above.
- EXEMPTION FROM CLAIMS AND TIME ELAPSE In the event that the guest wants to lodge any claim for non-contractual fulfilment of the tour, he or she shall lodge such a claim with Kamba Travel & Tours, within one month after the contractual planned conclusion of the tour. Kamba Travel & Tours recommends that these claims be lodged in writing. After expiry of the deadline the traveller can only lodge claims when he/she was prevented, through no fault of his/her own, from observing the deadline. No claim of a refund based on non-fulfilment of the tour contract shall be valid after the lapse of one year from the intended date of the conclusion of the tour.
- ENTIRE AGREEMENT These terms and conditions constitute the entire contract between the parties, and no representations, warranties or indications either prior or afterwards, shall become binding unless put in writing or notified to the guest in writing.
